ESM Terms of Service
The short version. ESM is a notebook for the subscriptions you already pay for. It reminds you before renewals and adds up what you spend. It has no connection to your bank and no way to see a real charge, so everything it shows is what you typed. Premium is sold and billed by Google Play, and you manage or end it there.
1. This agreement
These terms are between you and Fit4U, a sole trader based in Pakistan and the publisher of ESM. By installing or using ESM you accept them. If you do not, please do not use the app.
Your use of ESM is also subject to our Privacy Policy, and to Google Play's own terms where you obtained the app.
2. What ESM is — and what it is not
ESM records subscriptions that you enter by hand, pick from a built-in list, or take from a receipt you give it — a photo, a screenshot, a PDF, or a page scanned with the camera. From those entries it works out what you pay each month and each year, shows renewals on a calendar, and sends reminders before a renewal or the end of a free trial.
Please be clear about the limits, because they are deliberate:
- ESM is not connected to your bank, your cards or any provider. It cannot see a real payment, cannot confirm that a charge happened, and cannot stop one.
- ESM cannot end a subscription for you. Ending a subscription with Netflix, your gym or anyone else is something you do with that provider — for subscriptions billed through Google Play, in the Play Store's subscriptions screen.
- Every figure ESM shows comes from what you entered. If a price changes and you do not record it, ESM will keep showing the old one. Reminder dates are calculated from the dates you gave it.
- Reading a receipt is a suggestion, not a record. ESM fills the form in from what it managed to read and asks you to check it; it can misread a price, a date or a name, and it can be handed a document that is not a receipt at all. Nothing is saved until you save it, and reading a receipt still does not tell ESM that a payment happened — only that a document said so.
- ESM does not give financial advice. Nothing in the app is a recommendation about your money, and it is not a substitute for professional advice.
3. Your licence to use ESM
We grant you a personal, non-exclusive, non-transferable, revocable licence to use ESM on devices you control, for your own non-commercial use. You may not copy, sell, rent, sub-licence or redistribute the app; reverse engineer, decompile or attempt to derive its source code, except where that restriction is prohibited by law; remove or obscure any notices; or use the app to break any law.
ESM, its name, design and content remain ours. These terms grant you no rights in them beyond use of the app.
4. Your data is your responsibility
ESM stores what you enter on your device. We hold no copy and cannot recover anything for you.
That means: if you lose the device, reset it, or uninstall the app, your data goes with it. Two features exist so this need not happen — Export, which writes a file you keep, and the optional cloud backup to your own Google Drive. Keeping a current backup is up to you. We are not able to restore data that was not backed up.
You are responsible for what you type. Please do not enter full card numbers, passwords or anyone else's personal information; the app does not need them and has no use for them.
The same goes for a receipt you hand it: choose documents that are yours to use, and keep the original if you want to keep it. ESM reads the file and keeps no copy of it — only the values you accept and save.
5. The free version
ESM is free to install and use. The free version tracks up to 7 subscriptions, shows advertising, and unlocks the spending analytics screen for 24 hours when you choose to watch a rewarded ad. Everything central to tracking your money — reminders, the calendar, multi-currency totals — is free and stays free.
6. Premium
6.1 What it includes
Premium removes advertising, removes the 7-subscription limit, keeps the analytics screen permanently available, and enables backup to your own Google Drive.
6.2 Plans and pricing
Premium is offered as a monthly subscription, a yearly subscription, or a one-time lifetime purchase. Prices are set and displayed by Google Play in your local currency, including any applicable tax, and are shown to you before you buy. We may change prices for future purchases; for an existing subscription, Google Play will notify you of a price change and seek any consent the law requires.
6.3 Free trial
Where a free trial is offered, its length and the price that follows are stated on the purchase screen before you commit. Nothing is charged during the trial. Unless you end the subscription in Google Play before the trial ends, Google Play will charge the stated price at that point and the subscription begins. Trials are limited to one per account per product, at Google's discretion.
6.4 Billing, renewal and ending a subscription
All payments are taken by Google Play, not by us. We never see or handle your card, bank or billing details.
Monthly and yearly subscriptions renew automatically at the then-current price until you end them. You can end a subscription at any time in the Play Store under Payments & subscriptions → Subscriptions, or at play.google.com/store/account/subscriptions. Doing so stops future renewals; Premium remains active until the end of the period you have already paid for. The lifetime purchase is a single payment that does not renew.
Premium is tied to the Google account that bought it. "Restore purchases" in Settings re-checks that account.
6.5 Refunds
Refunds are handled by Google under the Google Play refund policy, and any statutory right of withdrawal you have under your local consumer law applies in addition. If something has gone wrong with a purchase, write to us at fit4u.apps@gmail.com and we will help where we can — though the refund decision rests with Google.
7. Advertising
The free version is funded by advertising supplied by Google AdMob. Where local law requires it, ESM asks for your consent before any advertising loads, and you can change that answer at any time in Settings → Privacy options. Rewarded ads are always optional: you choose to watch one in exchange for 24 hours of access to the analytics screen, and nothing is unlocked if you do not.
We do not control the content of individual ads and are not responsible for the products or sites they lead to.
8. Third-party services
ESM relies on Google Play Billing, Google AdMob, Google Drive (only if you enable backup), Firebase, Google Play services for reading text on a receipt and for the camera scanning screen, and a public exchange-rate service. Those services have their own terms and privacy policies, and we are not responsible for them. The Privacy Policy explains what each one receives.
9. Availability and changes
We work to keep ESM running, but we do not promise it will be uninterrupted or error-free, and features that depend on a network — prices, advertising, exchange rates, backup — depend on services we do not control.
We may add, change or remove features, and may stop distributing or supporting the app. If we discontinue it, we will give reasonable notice where we can, and the app already on your device will keep working for as long as your device and Android support it. Your data stays on your device either way, and Export lets you take it with you.
10. Disclaimers
To the fullest extent permitted by law, ESM is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement.
In particular, we do not warrant that reminders will always arrive or arrive on time. Android may delay or suppress background work — through battery optimisation, Doze, device restrictions or a restart — and notification delivery is ultimately in the operating system's hands. Do not rely on ESM as your only safeguard against an unwanted renewal. It is a helpful prompt, not a guarantee.
11. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect or consequential loss, for loss of data, or for any charge you were billed by a third party — including a subscription that renewed because a reminder did not arrive, arrived late, or was based on a date or price entered incorrectly.
Where liability cannot be excluded, our total liability to you is limited to the amount you paid us for ESM in the twelve months before the claim, which for free users is nil.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law. If you are a consumer, you keep all rights your local consumer law gives you, and nothing here overrides them.
12. Ending this agreement
You may end it at any time by uninstalling ESM. We may suspend or end your licence if you materially breach these terms. Ending the agreement does not by itself refund a purchase — see section 6.5 — and does not delete data from your device, which remains yours to keep or remove.
13. Governing law
These terms are governed by the laws of the Islamic Republic of Pakistan, and the courts of Pakistan have jurisdiction. If you are a consumer, this does not deprive you of the protection of the mandatory laws of the country where you live, or of the right to bring proceedings there.
14. Changes to these terms
We may update these terms. The date at the top will change, and for significant changes we will say so in the app or in the release notes. Continuing to use ESM after a change means you accept the updated terms.
